It is expected to move towards the path of equality for people, offering an opportunity to install the need to better the access to job offers to people that have been historically discriminated by their sexual orientation or gender identity.
This type of measures aim to promote the "Compensatory Justice", with which it is expected to compensate the disadvantages and the discrimination that we have suffered as group along history. A "distributive Justice" that would try to readjust the social disequilibrium that is existent and replace it with the “Social Utility”. This should mobilize the economic and social potential from all members of the society, for the common good.
Giving publicity to an act of discrimination has its risks, on of them is that conscious and unconscious enemies use the resources to lessen the fact per se and prevent other members of the excluded group from benefiting of similar acts.
Positive discrimination is a social policy directed towards the enhancement of life quality of the less favoured groups, by giving them the effective opportunity to equal their situation that is at a bigger social disadvantage. The mechanism signifies that the exception at the principle of equal treatment contemplated in the legal framework; this means in essence: give unequal treatment to that that is unequal de facto. SOMOSGAY is a communitarian organization whose main purpose is to defend and promote the freedom of sexual orientation, and specifically, the sexual orientation right to gays, lesbians, transgenders and bisexuals. It is also aimed to help with the answer to the pandemic of HIV, AIDS and other STI (Sexual a Transmission Infections) and to work towards the defense of the rights of people living with HIV/AIDS.
